House Bills 5211–5213, would create a presumption that 50/50 or equal custody is in the best interests of the child. While equal custody may sound reasonable and fair on the surface, extensive evidence-based research shows that this presumption is poor public policy. It increases the risks of harm to children, strains the judicial system, and is associated with higher rates of Adverse Childhood Experiences, and even fatalities including homicide and suicide. Even when domestic violence is recognized by the court, the level of danger and lethality is often not understood or assessed, limiting the court’s ability to make safe parenting plans. Creating a presumption of equal parenting time would push vulnerable children into unsafe arrangements while offering no benefit to cooperative families who already choose 50/50 custody voluntarily.

Representative_____________, My name is ________and I am calling to ask you to put children first and oppose House Bills 5211, 5212, and 5213 that support shared parenting.

A presumption of 50/50 custody is dangerous for survivors of domestic abuse. These bills prioritze parents' rights over children's safety, health, and best interests.

To keep children safe in custody decisions. we need bills mandating education on domestic abuse, child abuse, and coercive control for Michigan judges, rather than bills only focused on parents' rights.

Reports of abuse are often not believed in family court. How can children be safe when no one believes them when they speak up?

1 in 3 Michigan families experience domestic abuse and 75-90% of contested custody cases involve abuse. Judges need training on domestic abuse because it is often not recognized in custody cases. Training judges to make safe decisions is more important than a presumption to give equal custody to appease parents.

My experience in family court illustrates why 50/50 custody is dangerous....
